Absolutely - human rights are not within the state to provide: they’re entitlements. They’re within the state to protect. If the state fails, they still exist, and become adversarial. Which is why we always say to remain vigilant.

Your rights exist because you exist. Not because they do.
The assertion of human rights is normally unpopular with those in power. That’s why we have them.
