The structure + rates of tax are entirely a matter for the Scottish Government. It’s not a case of whether they “pass it on”. It’s entirely their own judgment. Since Scotland is at or beyond the cut off of the Laffer Curve, there won’t be room to increase rates to any great extent.

In the meantime cases can be pursued I’m the domestic courts, but judges will be required to follow the Supreme Court’s judgement in so far as it relates to the case in front of them.

Exactly. Not a challenge. I think the more likely outcomes of an appeal to Strasbourg is they decline to find against the UK, or that in the face of an adverse judgment it pushes Parliament into changing the law. But that all seems quite a long way away.
