Some engaged in visa fraud: Six staffing firms flagged by the USCIS for multiple registration abuse had supplied eight workers to Capital One.

Capital One said it's unaware of any government investigation, but declined to say whether it worked with the staffing firms.

Some visa middlemen are accused of discrimination: Tata Consultancy Services Ltd., Citi's largest supplier of H-1B contractors, is currently under investigation by the EEOC for alleged discrimination against non-Indian workers.

TCS denied the allegation.

Immigration law requires visa sponsors to pay H-1B workers no less than their similarly-situated American colleagues.

But because contractors are not directly employed by the end-client, they can be legally paid lower than direct-hires.

Citi, for example, added 3,000 new H-1B workers 2020-24. That's more than some tech giants like Nvidia & Oracle.

Yet most of them weren't Citi employees. Instead, 2/3 were contractors paid substantially less than those whom Citi hired directly.

Citi says it follows all laws.

Among the top 10 client companies we analyzed, contract H-1B software developers were paid $48,000 less than those employed directly - even after accounting for education-level and age.

1/3 of such contractors were paid exactly the minimum salary legally required by the DOL.

We unearthed reports TCS filed with EEOC showing that it had just 1/3 of the managers for whom it sought visas.

In a statement, TCS denied wrongdoing: “TCS rigorously adheres to all US laws.”
