BREAKING: The members of @pjminterconnection.bsky.social failed to decide on a plan to deal with the surge of demand from data centers.

That leaves it up to the board to submit a plan to @ferc.gov by the end of the year.

The issue isn’t “ending subsidies.” It’s:
1)Abrupt termination after major capex is sunk
2)Cutting eligibility at arbitrary in-service cliff
3)Unworkable FEOC rules that ignore supply realities
4)Imposing excise tax on our fastest-to-deploy resources
5)Doing all this amid spiking demand & tariffs

I hope this argument works but I'm not sure it does. When FERC is ordering a utility to file a rate schedule on behalf of someone else, that FERC can presumably then act on under 205 standards, it seems like you run headlong into AC.
Essentially, FERC said that a utility response to a rule is not the same as the sort of filing that the DC Circuit was considering in the Atlantic City case.

I'm on the edge of my seat to see how the utilities respond. They don't give an inch. I doubt they let this go. We'll see in 30 days!
