This is super low key rebuttal of govt case, focusing solely on comms after Richman left FBI. There's reason for that: bc Comey shared classified details of SVR in January 2017.

I have no idea how much Comey & his lawyers & James & her lawyers are chatting--ultimately this is all going to the same District Judge & the same Circuit. & both defendants are accomplished lawyers.

But James & her team took this argument abt Immigration law, which may matter upstairs, at SCOTUS.

In hearing before William Fitzpatrick on Comey bid to get grand jury transripts (where Fitzpatrick decided he'll review the transcripts in camera w/a submission from Comey's lawyers about what to look for), Loaner AUSA Diaz said they presented 14 exhibits to GJ.

2) The apparently got the ENTIRE Cellebrite extraction for Richman's iPhone.
3) They claim not to know who Michael Garcia was but reviewed anyway when looking for comms bt Comey and Richman. 🤔

But yesterday those same Loaner AUSAs told Comey they have no fucking clue if they were reviewing responsive sets or not.

FBI: Oh yeah, the FBI agent who read Jim Comey's privileged comms with Dan Richman TOTALLY briefed the GJ witness on those comms. But bc the Agent only PUT IN WRITING STUFF pre-May 11, it's all good.

DOJ: We recognize the privilege started on May 9.
