I agree it’s dire, and it’s clear they’re coming for the broader provider ecosystem. My point was that I read this regulation as not touching non-hospital providers who take medicaid. Which, agreed are few and far between.

But seriously, this isn’t intended to be criticism. You do amazing work.

It looks like per this proposed regulation they’re acknowledging that a substantial number of patients receive gender affirming care outside of hospitals, and they’re currently gathering info on that. See pages 29 and 30 of the proposed regulation PDF. So unfortunately that’s on their radar too.

Thank you for your reporting! This is dire, but I don’t read the Medicaid definition of “hospital” as broadly as you do here. Independent providers and non-hospital clinics may be more resilient options for patients even in the face of this. At least for now.

Happy to expand on this if desired.

Yes, it’s far beyond the 24/25 term average time for ruling on Trump admin emergency applications, which was 32 days. This one has been pending for 45 days and counting.

Such absolute cowards. These are the people who are best situated to publicly oppose Trump. But they’re too afraid to do it, so it falls on far more vulnerable people to do the work. It’s utterly shameful.

This “lawless thugocracy” drives me insane. One reason I went into law is I hate not understanding things that exert power over me. It’s complicated, but the rules are understood. But this shit is a black box of lawless whim. I don’t know how to navigate that. I don’t know how to advise about that.

Yes, exactly! EOs are not laws, but state anti-discrimination laws ARE. Illegal pressure coming from the president, as intimidating as it may be, does not excuse these organizations from their legal obligations.

This is the development I’m hungry for right now. We need test cases to pressure the state AGs to enforce non-discrimination laws. The law isn’t vague here. Discrimination isn’t permitted, and taking federal funds is not required. Institutions need to start saying “no” to these illegal EO demands.

It’s always the same. If only there was some sign the GOP wasn’t supportive of lesbian and gay people. Maybe if the GOP had just recycled the same attacks on trans people, verbatim, that they used against LGBTQ people for decades it would have been obvious enough for people like this. Oh, wait. 🙄

One thing that drives me crazy with this kind of take from the NYT is that it implies that just because an action is legal, it shouldn’t be criticized. That’s…insane. Something being legal is table stakes. Something being legal doesn’t mean that it is moral, beneficial, or wise.
