So it looks like my second Substack article will answer such eagerly awaited questions as:
Can he sue the BBC in Florida?
Will he sue the BBC in London?
What are the differences in US and UK defamation laws?

Threatening to sue the BBC is basically threatening to sue the British people, as the majority of its funding comes from the license fee paid by UK households.

Judge: An ex parte submission that is limited to that issue would be welcome and i'll determine what weight to give it.
In camera review would be very helpful and puts me in a far better position. I will grant govt request.

Judge: The question before me is a very narrow one, whether there's a basis under 6(e)* for particularized findings necessary to require disclosure in whole or in part.

Gabriel Diaz for DOJ: We could provide grand jury materials to the court in camera, not sure what defense is talking about in terms of ex parte submission. Neither of the two issues (privilege, Fourth Amendment) go to grand jury material that would give a basis to dismiss the indictment.

Donaleski: Materials we believe are at issue with respect to Comey's privilege, we've now seen what the agent saw that was clearly privileged. It would better enable court to understand taint and unconstitutional violation...
Judge: When can you make your submission?

Judge: What do you envision in terms of ex parte* submission, what would you be referring to?
*'by/for one party', so this submission wouldn't be seen by DOJ, just the judge.

Ms. Donaleski for James Comey: We believe that the defense is best positioned to review, familiar with the materials and can say where evidence comes from, familiar with the attorney-client privilege. We'd be willing to make an ex parte* submission from defense following review of materials.
