I'm not sure if there are any rules that specifically mandate HOAs, but when they require subdivisions to maintain their own streets and/or require subdivisions to have common areas, they effectively mandate HOAs. And this is super common in TX.

I’m very sympathetic to the theory of HOAs and deed restrictions providing a voluntary alternative to zoning, but now we’re in a place where in lots of the country it’s difficult or impossible to build a new single-family house that’s not in an HOA.

My beef is absolutely not with legalizing or building additional multi-bedroom units. It's just with the argument "we don't need more studio apartments for singles, we need houses for families," which I'm hearing with increasing frequency.

But for the sake of making it possible for more people to have kids, I think even more focus should be on legalizing small, inexpensive rungs on the housing ladder.
