There have been some cases where a retrial was allowed, essentially on the theory that you were never really in jeopardy, a bribed or coerced jury is no jury at all, basically a fake trial, and so double jeopardy doesn't attach. But it's extremely rare (mobsters, mainly) and an extremely high bar.

Judge Ellis wasn’t mad in this hearing. She was eliciting the facts needed to show that these violations are knowing, pervasive, and the result of institutional policy that that runs counter to clearly established law.
