He's from a previous marriage so this is more like a step-child issue than a queer marriage issue if I understand the situation correctly. The wife may be able to care for him but if she didn't legally adopt him there may be other issues.

I don't think she's his mom, he's from a previous marriage and we don't know if she has any kind of legal adoption or guardian powers for him.
