There are serious issues regarding costs to districts for special education costs, evaluations and compliance for students that are in their districts that enroll in private schools. #idleg
Private School Special Ed Equitable Services Considerations: When students w/disabilities opt for private school attendance through school choice programs (such as vouchers or tax credit scholarships), public schools may face financial challenges, including: 1. Increased Costs for Special Ed Evaluations Under the Child Find mandate of Individuals w/Disabilities Ed Act (IDEA), public schools remain responsible for identifying & evaluating all students w/disabilities, even those attending private schools. If more students move to private schools, public dists may see an increase in evaluation requests, leading to higher costs for: Psychological & ed testing Specialized assessments (speech, occupational therapy, etc.) Staff time & admin oversight This obligation remains even if the student does not receive special education services in the public school system. 2. Increased Costs Under Proportionate Share Requirement IDEA requires public school dists to allocate a proportionate share of their fed special ed funding (Part B) to provide equitable services to students w/disabilities enrolled in private schools. If private school attendance rises = number of eligible students increases, leading to: More $ diverted away from public school special ed services Higher admin & service delivery costs (e.g., transport, contracted special ed providers, consultation w/private schools) These services are typically limited & not individualized like an IEP, but dists still must ensure compliance. 3. Shifts in Funding but Continued Fixed Costs If funding follows student to private schools (through vouchers or tax credits), public schools may experience: Loss of per-pupil funding (state/local) Struggles to reduce costs in proportion to declining enrollment, since fixed costs (e.g., facilities, staff salaries) remain Special education services often require significant resources, and if fewer students remain in public schools but fixed costs persist, this could put financial strain on remaining programs. 4. Potential Legal & Compliance Costs If disputes arise regarding the provision of equitable services or IDEA compliance, public schools could incur: Legal fees for due process hearings or complaints Increased staff time to navigate compliance issues 5. Increased Need for Coordination and Service Agreements Public schools may need to coordinate more closely with private schools, leading to: Increased administrative burden More contracts with private service providers Challenges in service delivery logistics (e.g., transportation, location of services) While school choice can provide options for families, it can introduce financial and operational complexities for public school districts, particularly in maintaining their obligations under IDEA. Public schools are required to offer free evaluations for special education to private school students under the Child Find obligation of the Individuals with Disabilities Education Act (IDEA). Key Points: Child Find Applies to All Students, Including Private and Homeschool Students Public school districts must identify, locate, and evaluate all children who may have disabilities, including those who are: Enrolled in private schools Homeschooled Highly mobile (e.g., migrant children) Evaluations Are Free Public school districts must conduct special education evaluations at no cost to parents if a disability is suspected. These evaluations determine whether the student qualifies for special education services under IDEA. Evaluation Does Not Guarantee Services from the Public School Evaluation Does Not Guarantee Services from the Public School If a private school student is found eligible for special education, they do not automatically receive an IEP (Individualized Education Program). Instead, they may be eligible for equitable services under a proportionate share of IDEA funding, which is limited and may not cover the full range of services available through an IEP. Public schools are not required to provide the same level of services to private school students as they do for public school students. Responsibility Falls on the Public School District Where the Private School Is Located The public school district where the private school is located (not where the student resides) is responsible for conducting evaluations and providing any equitable services. If a student later enrolls in a public school, their eligibility for special education services transfers, and they can receive a full IEP. Parents Can Disagree and Seek Further Action If parents disagree with the evaluation results, they can request an Independent Educational Evaluation (IEE) at public expense or file for due process. Impact on Public Schools: Increased requests for evaluations from private school students can lead to higher costs for assessments (e.g., psychological testing, speech and language evaluations). Public school districts must allocate staff time and resources for evaluations, even if the student does not attend the district’s schools. The district must also maintain compliance records and ensure that all private school students with suspected disabilities are evaluated in a timely manner. In short, public schools must provide free special education evaluations for private school students, but service obligations are limited compared to what public school students receive.
