These people are only dumb if they actually believe what they're saying. I think it's far more likely that they're being disingenuous. They believe that their supporters are dumb, and will believe – and repeat - the ignorant things they say.

It doesn't matter whether you or I agree that it's legitimate. The important question is whether or not the Constitution agrees, as interpreted by the highest court that hears the case.
Any other interpretation of "legitimate" is irrelevant, unless we are ready to abandon the rule of law.
