I'm talking specifically about art that isn't used in the game at all. An artist creates art for the game (A). Then the artist draws another piece of art (B) for themselves (no one pays for this). But someone then retraces the drawing (B) into the game to match the original artist's style

Here's a tricky one: is it ethical to trace other (not game-related at all) works by the original artist to capture their style, and then include those images in the sequel?

Yes, it's more complicated. I think it would be simpler if the contract specifically stipulated the transfer of rights to the drawing. Specifically, I believe that the artist has the right to their art (public display), even if they received money for it, provided there is no contract

I'm an artist, but even I don't know. But I mostly agree (still just an opinion)

It works both ways: it's much easier to see when someone is meticulously copying another's work with a simple correlation of key elements in place (do the contours, eyes, mouth, etc. match)

I don't entirely agree: using tracing, you can inadvertently pass off someone else's work as your own, creating a false impression of your own ability level.
But that doesn't mean I don't like your point of view

Yeah, it's probably legal. I don't remember anyone getting in trouble for having a Scooby-Doo with blue ears and a different name in their work or anything like that.
