Kassem is getting into the merits of his petition now:

"Mr. Khalil was taken at night as he was returning home here in NYC he was moved 1000 miles away to Louisiana after a habeas petition was filed with this court… raises significant constitutional concerns."

Prosecutors say they want to transfer the case to New Jersey, since that's where Khalil was housed when he filed his habeas corpus petition.

Waterman says there "could be an argument" to transfer the case to Louisiana, too, where Khalil is right now.

AUSA Brandon Waterman confirms that Khalil is being housed in Jena, Louisiana. He was transported there over the weekend after initially being taken to a facility in Newark, New Jersey.
