While this EO is much more subtle in the language they use, their intentions have been laid out in court cases across the country. Earlier this year, a district court judge in Texas blocked the Biden HHS protections in court, allowing prospective foster/adoption by vocally unaffirming parents.
Nauseating ruling that previous HHS requirements prohibiting trans children from being placed with deliberately unaffirming foster families violates Texas law. In part, they argue it would interfere with the ability of DFPS to investigate affirming families.

This trend of the BIA dictating rulemaking on the use of discretion and even trying to amend the INA via Board decisions to be anti-immigrant is awful.

They're publishing so many awful decisions as of late and it's all to enucleate protections for noncitizens.
