Clarification: Victoria v Adams only guarantees a right to seek temporary shelter overnight. It doesn't guarantee a right to permanent shelter, nor shelter during the day. This was upheld in Abbotsford v Shantz.

This will never happen but in some universe, Rustad is forced to seek an interlocutory injunction from the courts permitting him to stay on as party leader while this is litigated.

Realistically though, he'll step down once party donors start to pile on the pressure.

Parties are bound by their own constitutions. They're basically contracts between the party and its members. If the constitution gives specific scenarios where a leader can be removed, the leader can't be removed for another reason, which is why the meaning of "incapacitated" is a legal question.
