Why wouldn't this apply in both cases?
It's possible that they can remove that shadow of a doubt, but it is a good move to force them to because it creates a chance for them to mess up.

Imagine if instead of paying taxes so people could get healed I could pretend I'm saving money but pay taxes and fees elsewhere to pay for emergency rooms, medial care for things that could have been prevented, and the criminal justice system for people bankrupted by healthcare.
