Well, the state is an essentially contested concept but, many (wrt Dhal, North and, unfortunately, Weber) would define it that way.

I mean, yeah actually- if the developer isn't reinstated by the actual state that means that collective of people now hold a monopoly on the legitimate use of force in a regional area and are now occupying it in opposition to the actual state.
