As always courts will have to figure out how to apply existing law to new technology but I'm confident there's a cause of action somewhere in the invasion of privacy torts.

So I think the best approach might be false light invasion of privacy. That's usually been limited to statements ABOUT someone, not "by" them, but I don't think that's necessarily required. www.findlaw.com/injury/torts...

But the problem there might be that misappropriation has generally been limited to commercial use. Probably because until recently, just doing it for the lulz would be parody and fall into Falwell v. Hustler territory. Genuinely deceptive misappropriation was hard. en.wikipedia.org/wiki/Hustler...

No. Through the whole thing. Essential employees stop getting paid when the funds run out--which they never have, by the way--but they don't get furloughed.

Well, that's not true at all. Federal judges, chambers staff, and a number of clerk's office staff are essential employees who work through government shutdowns.

The worry would be that in a post-House v. NCAA world, the Big East won't have the money to compete for talent. If that seems likely then a Big Ten job gets much more appealing.

To me, watching the video knowing the cane is there, it sure looks like he didn't see her hand right away, she didn't see his cane right away, and neither was quite sure what to do when they noticed one another, so they kind of awkwardly just took the picture.
