The proposed federal COVID-19 liability shield bill is Exhibit A for how floor preemption (ie, “minimum standards”) doesn’t always benefit public health. Preemption is too often abused (see AZ, GA, TX) but we must evaluate preemption laws on the merits, not by how they’re framed.
