In any dismissal there is a risk that a Tribunal would find it unfair. The question is whether the employer should be protected from that risk for a period after recruitment and whether such protection would make them more likely to take a chance on recruiting someone.

It just went through on the nod. The main Lords amendment was accepted by the commons but there was an amendment in lieu extending the scope to cover missing discrimination claims. No one opposed it and there was no vote.

I think it would lead to an arms race. If employees could essentially lawyer up for a hearing then employers would want to do the same. Hearings would get more legalistic. Of course reasonable adjustment might be in order when an employee has a disability

I’m sure the end will be no change once employers realise what is being suggested. The idea is that workers should be entitled to be accompanied by trained representatives who are neither trade union reps nor fellow workers. Surprised the Tories in the Lords seem to be in favour of that.

I don’t think we need worry about new fangled counties like Tyneside or whatever they are calling it nowadays.
