We can admit that the feeling of shame can not only be constructive, but also deeply corrosive—whether one internalizes shame or is prompted to the emotion by others’ disapproval. But so, too, are some of the moral and personal failures that give rise to that disapproval. In some cases, these are poisonous enough to merit the harsh medicine of shame and shaming. If not during the rise of fascism, then when?

But that the amendment passed Wednesday is “one of many warnings” that these types of actions are happening here, too, they said. “We are not in a time where it’s alarmist to say people need to get involved and know what is going on at the local and state level,” Croke said. “The attacks on trans students over sports is a tactic that is continuing to be used to distract from the other work that is being done to create less safety in our communities. In the middle of the night recently, I woke up and looked at my phone. I had messages from two people I love and a news alert with the ominous headline: “White House collects lists of federal DEI office employees as punishments begin.” With the second Trump administration, the anti-state state has reached an apotheosis of sorts: a state that cannot help and does not want to, that restricts access to health care and withholds life-saving aid, that can only deliver punishments of various kinds. A state that could help would be so different from what we have now that we might not even call it a state anymore. This is what we must imagine now, a thing that feels impossible. Gilmore, in a talk at this past autumn, suggested, “Imagine abundance as entitlement that binds us in radical interdependence. Just imagine it and then do something to realize it.”

The political struggle underway today is not over transgender existence (which, for the record, cannot be targeted because transgender people arise randomly within the population and are not an ethnic group), it is over the material conditions of possibility for transition, whether access to public facilities, access to education and the labor market, or access to hormones and surgeries. In the case of Skrmetti, I would contend that the outcome prescribed by Tennessee’s law ought to be accountable to the documented material harm the many young people denied access to hormones and surgeries over the past seventy years endured. Is it tolerable to consign all transgender children today and tomorrow to the fate of so many already denied medical transition in the past? That is the question that history asks us to confront.

Those using GPS devices like a VeriWatch face the risk of technical violations—a grave consequence for those whose limited freedom is tied directly to abiding by certain conditions of release. The concerns surrounding smart technology extend to those in immigrant detention. Under the Biden administration, the use of surveillance technology has ballooned. According to reporting from last summer by Fast Company, there were about 80,000 immigrants living under some form of digital surveillance before President Joe Biden took office. Advocates now believe the current number is about 200,000.
