Just to show how much of a shitshow the Chinese legal system is, 民法总则 and 民法通则 were in force at the same time – I used to get confused as to which provisions of which law applied in each circumstance. So expecting them to make 刑法 or 行政法 amendments for that would be basically asking for a miracle.

Sadly, even in 2025, Chinese law is still being written – the Civil Code entered into force only in 2021(!) (replacing the General Provisions of Civil Law (1986) and the General Rules of Civil Law (2017)). (4/?)

As to what the government gains from this, they just pretend that the problem doesn't exist or it's too complicated to solve, thus saving money on enforcement mechanism funding. (3/?)

The government considers this as very low in their priority list to the point that they can’t think of the way to draft the article in the Criminal Code properly, not to mention oftentimes toothless law enforcement mechanisms in many aspects.
