There's been so much to keep track of!

They hadn't, before today. 9th Circuit did recently decline an en banc review in CA's case though. Since Oct. 20, OR has been waiting to see whether the 9th Circuit Court would rehear the appeal.

Today's hearing was to consider whether Judge Immergut should nullify that TRO, since the 9th Circuit ruled that troop deployment is OK. Immergut previously issued 2 TROs, one of which was challenged in court. Fed gov't wants the other TRO lifted immediately, even though it expires next week.

To recap: Appeals Court ruled Nat'l Guard troops CAN deploy to Oregon. Then a judge asked for that ruling to be reconsidered by a full panel of judges (rather than just 3). Unclear whether that will happen. Meanwhile, the fed gov't was barred from sending other states' troops to OR due to prior TRO.
