I've been wondering the same. And this reasoning applies to some jurisdictional stripping questions of late. Can the court say Congress meant to channel claims to other processes when those statutes were enacted on the assumption that certain positions were "independent" and are no longer such.
Justice Kagan asking really interesting question about how the *Court* should construe a delegation statute when it was enacted on the assumption of a legislative veto. [14]

Judges are starting to demand Government responses to the bombshell UN documents where El Salvador claims no sovereign interest in the prisoners sent from the US. storage.courtlistener.com/recap/gov.us...

Is arresting someone while attending court proceedings more than just bad policy? It seems to chill both an individual's First Amendment right to petition via court, and the court's privilege in not having others interfere with its administration of justice.
That said, even if the arrest was lawful, that doesn’t mean it was a good idea. This report notes that the guy was arrested BEFORE his court hearing, and in his DUI case was noted down as a failure to appear. So it’s screwing with him in that case by interfering.

And ALSO also where the government maintains that DOD sent several people to El Salvador after the injunction was issued, but DHS wasn’t involved (suuuuuure) and the injunction only applied to DHS so it wasn’t a violation

I believe the 4th Circuit's administrative stay of a paragraph from J. Gallagher ordering the Government to facilitate the return of Cristian to the US (from CECOT) expires today. I expect an order either granting or denying a stay pending appeal will issue tonight.

The TRO halting use of the AEA from J. Haines in WDPA expires today at 3:12pm. She had a hearing on a preliminary injunction a week ago and I fully expect her decision in the the next few hours.

Sure enough, the ACLU uses Trump's ABC interview where he says he could get Kilmar back, for its claim that the US has constructive custody over detainees sent by the US. Thus the district court does have jurisdiction over their habeas claims. storage.courtlistener.com/recap/gov.us...

J. Sweeney in Colorado will rule in the next 24 hours on a TRO protecting a putative district wide class from removal under the AEA. The main challenge is that the Gov't says it currently doesn't view named plaintiffs as subject to removal under AEA (even though alleges they are TdA). 1/2
