Officially PD Dr. iur. 👩‍🎓— holding this diploma in my hands feels almost surreal. I‘m relieved, proud and so excited to start sharing the insights gained in my research on the implications of the internationalisation of law for state order and generational justice!

The legal uncertainty surrounding non-military pressure in international relations can therewith trigger a «doom-loop», to the detriment of the global rules-based system.
May 7, 2025 at 8:03 AM
As it turns out, even though non-military pressure in my sample did not amount to (prohibited) coercion, it forced states into action – in their attempt to preserve sovereignty and economy, states were prepared to violate their own obligations in international law.

Last week was a big one – not only did I get rid of the splint I had to wear since breaking my wrist in a snowboard accident in February, I also held my habilitation presentation, followed by the award of the venia legendi in International Law, EU law & Constitutional Law by the University of Bern.

There is some comfort in the fact that there have been desperate times for international law before (Oona A. Hathaway, Between Power and Principle, 2005):

Ich habe zum 1. Mal meine Forschungsergebnisse aus 8 Jahren Arbeit an der Habilitation präsentiert – an der politikwissenschaftlichen Winter School der @uni-wuppertal.bsky.social ! Abrufbar hier: www.youtube.com/watch?v=27cI...

Sehr gefreut haben mich die vielen spannenden Fragen in der Diskussion.

Ever wondered what a glacier looks like from within? That’s it.

You‘re very welcome. 😊

PS: totally better than reading the news…

In the fourth article, @timlmeyer.bsky.social points out that non-economic, extraterritorial effects also qualify as negative effects of trade liberalisation. Policies addressing these – so-called second generation flanking – are more trade distorting and consumption-oriented than earlier policies.
January 14, 2025 at 3:59 PM
The third article by Kathleen Claussen turns to the domestic implementation of trade agreements – a generally underresearched aspect of trade liberalisation: accompanying measures & institutions are critical for the containment of negative effects of trade liberalisation.
January 14, 2025 at 10:57 AM
In the second article, Camille Reverdy, Giovanni Donato and Richard Baldwin analyse the role of ex ante and ex post impact assessments (IAs) in fostering public acceptance of trade agreements. They study the evolution of coverage and methodology of US & EU IAs 1990-2023 - first database of its kind!
January 14, 2025 at 10:51 AM
In the first article, Joost Pauwelyn & I summarise the shortfalls of the traditional silo/subsidiarity approach to dealing with negative effects of trade liberalisation (some 'negative effects' might be inevitable...) and lay out the details of the conceptual framework of package treaties.

In the editorial, @noemielaurens.bsky.social & I explain how benefits of trade are at risk due to structural reasons & political decisions that led to losers of globalisation within nations & to environmental & climate degradation. The special issue is explores alternatives to maintain open markets.

Here for the remaining days of this genuinely crazy year - at the global as well as the personal level. Offline until 2025! 🥳 … wishing you a favorite spot, far away from everything and, while enjoying the view, a tiny tickle that lets you know that you are ready for this next trip around the sun. ⭐️

Almost 10 years after entry into force of the #Agenda2030, the first legal commentaries are finally available. I reviewed the one by Ilias Bantekas, Francesco Seatzu & Katerina Akestoridi (OUP 2023) for Zeitschrift für das Recht der nachhaltigen Entwicklung here: biblioscout.net/content/99.1...

Creating room for interactive learning is one of the more welcome teaching-challenges for me. A particularly great instrument is the cooperation with a global South university: this year again, my #Zurich students worked together with Victor Saco's #Lima students & participated in an online debate.

Surprisingly pleasant change to my Thursday-morning routine: recording of the swissinfo Podcast „let‘s talk“ on the future of Swiss foreign trade policy.

Perhaps my routine has become a bit boring over the years, but discussing trade-related interests and the benefits of multilateralism was fun.

A mere reference in the law to sustainable development does not meet the required level of appropriate regulatory density and precision. To avoid judge-made law, legislators ought to identify specific measures rather than an overly vague goal.
November 19, 2024 at 1:59 PM
There is a normative core to sustainable development on which the global community appears to begin to agree on. Unfortunately, many measures currently in force are in violation of the normative core of sustainable development (use of non-renewable resources, violations of core human rights).
November 19, 2024 at 1:55 PM
#sustainability is a #goal and in principle focused on preservation. #sustainabledevelopment is a #process and no synonym of sustainability (and vice versa). Sustainable development embraces change – hence, its goal (sustainability) can be reached also by disruptive means.
November 19, 2024 at 1:51 PM
(5) The social dimension of sustainable development remains under-researched – despite the fact that (contrary to #sustainability) sustainable development cannot succeed without #equality, #dignity, #education and #security. ... Reason why the next project of this platform will address just that.
November 19, 2024 at 1:37 PM
(4) Multidimensional measures (measures in different fields with the same goal) are a promising tool for sustainable development.
November 19, 2024 at 1:35 PM
(2) #greenhushing not only occurs for fear of exaggerated expectations and accusations of «greenwashing» (which is well known), but increasingly so also for fear of being denigrated as «woke». (3) It remains unclear whether a «no-go»-list would strengthen implementation of sustainable development.
