Transit peace officers give trespass tickets after they first ban someone for a period of time that could be anywhere from one day to two years, and the banned person enters transit property or vehicle. They ban people for a variety of reasons. Some legitimate, some questionable.

Kyle also complained of other officer misconduct during the arrest, including officers threatening to kill him and calling him an anti-gay slur. That complaint, among others, never made it to a hearing. Here’s Chief McFee’s rationale for dismissing that one from his November 2 2023 decision letter.

But, the Edmonton Police Commission declines to investigate because I don’t have standing. Among other things, the complaints director tells me that I lack standing because I didn’t witness McFee write or submit the opinion piece.

In the final dismissal letter, Chair McDougall gives no reasons.

Meanwhile, I’ve complained to the Edmonton Police Commission that the Chief lied or misstated facts in his opinion piece when he said 11 people were referred for treatment instead of 1.

I FOIP AHS for all cold-related EMS responses and ER visits on Jan 22 2024. They say the number is less than ten so they can’t release the actual number for privacy reasons.

I FOIP the EPS file. I get Cst. Chaudhary’s notes, which show just one person was referred and doesn’t mention the other ten. I FOIP the EPS again for any other records. Again, nothing on the other ten people who Chief McFee says were referred for treatment.

In August 2024, Chief McFee responds to news reports that the EPS’ encampment evictions may be contributing to a spike in frostbite amputations by writing an opinion piece.

In it, he says that during this Jan 22 eviction, 11 people were referred to emergency medical treatment, instead of 1.

On Jan 22, 2024, EPS CST Chaudhary’s duty was to evict encampments near Bissell. In one, he discovered a woman who was not dressed for the weather and who needed emergency medical help. He referred her to a paramedic.

Later, I learn of this thru a freedom of info request and send him a compliment.
