It’s not unreasonable to ask for experts to get into the weeds — at least for some audiences — of how they are Just Doing Law Badly and Wrong, and will fail.

But you’re right that we can’t lose sight of the awful contortion of it all.

At the same time, FRCP don’t recognize a motion to dismiss on account of this is obvious BS. To the extent courts will treat it like they’re Just Doing Law

I mean, that’s exactly what Aaron Swartz was indicted for. Over which he died by suicide. Though SCOTUS has since rejected that overbroad reading of CFAA
