In today's birthright citizenship decision, the majority of the justices take the position that courts sometimes can't force the Executive to follow the law. That begs the question: if courts can't force the president to follow the law, who can?

Yesterday, my Ohio State colleague, Emily Brown, who runs our immigration law clinic, sued DHS over its decision to terminate an OSU PhD student's immigration status. They walk into federal court today. I couldn't be prouder to be part of an academic community that sticks up for our students.

The newest lawsuit challenging the Trump administration's attempted use of the Alien Enemies Act is brought by two Venezuelan citizens living & currently detained in the Denver area. Federal officials have described both as Tren de Aragua members.

The president of Ohio State has confirmed that DHS has revoked the F-1 visas of multiple OSU students. The university hasn't received formal notification or information from DHS, he wrote. Rumors have been circulating about this for many days.

In a separate concurrence, Judge Wilkinson supports reading district court's preliminary injunction order as requiring Trump administration to "facilitate" Abrego García's return but not more than that.

In a terse order, Judge Paula Xinis in Maryland orders the federal government "to facilitate and effectuate the return" of Kilmar Abrego García to the United States. Now we'll find out if the Trump administration does it. My guess is they appeal the judge's preliminary injunction.

Is it my perception only or have there been more errors & typos in Justice Department filings recently? This one paragraph from DOJ's latest submission in the Mahmoud Khalil case includes 3 mistakes. Proceed should be process. More should be moreover. Due Process should be followed by Clause.

A federal judge in Denver has scheduled a hearing in activist Jeanette Vizguerra's fight to get out of an immigration prison & avoid deportation - meanwhile, the judge has told ICE not to move her out of Colorado or the United States.

In papers filed with the Supreme Court today, the Trump administration reiterates that they are attacking birthright citizenship as we've known it for 125 years. If they get their way, that would mean generations of people who lived & died as US citizens were never US citizens.

DHS says Mahmoud Khalil's presence in the US creates "serious adverse foreign policy consequences," apparently relying on nothing more than his speech. Sadly, yet unsurprisingly, the Notice to Appear gets wrong a section of federal immigration law. INA 212(a) isn't about adjustment.
