California's lawyer explains why any criminal referrals for Posse Comitatus Act violations would be an unworkable remedy — they woudl go to the same Justice Department defending those actions.

"We['d be] asking the federal government to police themselves, and that raises federalism problems."

California's Deputy Attorney General Meghan Strong says the government's arguments that there's no civil remedy for Posse Comitatus Act violations "defies basic principles of federalism."

California Deputy AG:

"What James Madison would have done and what he did was he drafted a Constitution that would not allow the President to deploy standing armies... as a king had" before the Constitution's ratification in 1788.

Here is the takeaway: the party in power used decontextualized emails and made-up theories to dismantle state capacity to track foreign interference. It now wants to shut down First Amendment protected research that threatens its power in any way.

That is the censorship.

And even worse, it used the preliminary legal injunction of Murthy vs Missouri to support its argument, but ignored the actual outcome, which contradicted it; ie, the Supreme Court ruling, and Justice Barrett’s actual argument supporting that ruling.
