If you are on a student visa and are protesting at your college/university: Avoid actions leading to suspension from your school, as that could risk leaving you out of status. Avoid actions leading to arrests, which could result in the cancellation of your visa by the Department of State.

10. Avoid sharing any photos, videos, or other content signaling your participation in the protest. Law enforcement, including ICE, is known to monitor protestor social media accounts and can use any online postings against you.

9. Do not plead guilty to anything without having your criminal defense attorney consult with an immigration attorney first. Your criminal defense attorney has a legal obligation to do so.

8. If arrested, locate an immigration attorney as soon as possible, or better yet, ask an immigration attorney to be “on call” during the protest activity. If you’re able to, alert any local rapid response networks about ICE activity or collaboration.

7. If arrested, within 24-48 hours of your arrest, you can generally expect to see a judge to hear what you’re charged with and whether you’ll be released or have to pay bail. You’ll be assigned a criminal defense attorney who you’ll probably meet just before the hearing.

5. Knowing how the jail and ICE collaborate can impact whether bond or bail is paid for a noncitizen protestor: In some locations, paying bond/bail can trigger a transfer to ICE. In other places, paying bond/bail quickly after arrest will avoid an ICE transfer.

3. Memorize or write down the number of your lawyer or legal/jail support hotline and emergency contact.

4. Know to what degree local law enforcement and the jail cooperate with ICE (ideally before taking to the streets). Some cooperate closely with ICE, others less so.
