I was thrilled to file this motion yesterday. Public access to court filings is a foundation of our democracy. Don't let the powerful hide behind protective orders. Force them to play by the rules and justify every single redaction.
1. Today, ILSR filed a motion in federal court to unseal the FTC’s antitrust complaint against PepsiCo. The case bears directly on high grocery prices and food deserts — and would've marked a crucial revival of the long-neglected Robinson-Patman Act. But the public may never get to see it.

Defying Supreme Court orders, w/ a complicit Congress, is not just a constitutional crisis. It is a constitutional failure. We're officially in an autocracy. Time to start disciplining lawyers who defy court orders. Revoke licenses and court admissions, deny PHV apps, enforce the rule of law.

Thank you Judd! The media sowed chaos and confusion yesterday. DealBook this morning still calls it a “buyout package”. But it’s really a poker game putting a lot of federal employees in a tough spot. Those who don’t read the “Fork” closely could easily be deceived into something they don’t want.
This is grossly irresponsible reporting by the AP. What’s being offered is not a buyout. The deal is if you agree to resign in September you can continue working remotely until then. There is no buyout or severance.

🏆The 5th Cir. rejected wholesale Illumina's appeal. Its reading of sec. 7 eschewed overly formalistic "hard metrics" and self-serving promises in favor of common sense and embraced "the purpose of Section 7—'to arrest anticompetitive tendencies in their incipiency.'" Huge win 🏆

NCAA prez Charlie Baker really stirred things up in the business of college sports today. As I said on the other site, his proposal isn't perfect. But it is a textbook example of how vigorous antitrust enforcement leads to better working conditions and a fair economy.
