Wasn't that under the authority of the AUMF? I don't think there is an equivalent Congressional authorization here, which leaves a purely inherent executive power argument. The lack of imminent harm or need for self-defense is hard to justify. . .

The Miscellaneous Receipts Act would prevent use of these funds for anything. The funds are deposited to the Treasury and can then be used but only for amounts already appropriated. You would still require Congress approval to spend via an appropriation.
