In other words, the pilots fought all the way to the ground and kept it somewhat survivable.

Having an open and unfenced sidewalk is an invitation/limited license for people to enter the curtilage of your property - especially in a semi urban area like Berwyn.

She could very well have been an errant food delivery or wrong house

I live not too far from him. People probably knock on his door a couple times a week - maybe even the same people who knock on his door knock on mine.

He hasn’t any “no trespass” signs or even a locked gate.

He has a sidewalk and a doorbell. Anyone can ring his doorbell unless told otherwise

That statement in Burdick was “dictum” and not part of any ruling or precedent.

The 10th Circuit Court of Appeals recently ruled the opposite. Lorance is more applicable because it addressed the matter head on. In Burdick “imputation” was merely listed as a reason one “may” reject pardon.

People keep referencing a nonexistent case-law/rule/whatever that accepting a pardon is an admission of guilt.

That’s based on an off the cuff statement (otherwise known as dictum in legal circles) in a 100 year old case.

I guess we could ask each individual if they would rather have a “air” or literally $1million in legal fees if they have to fight a criminal indictment. Just an investigation alone could cost the target high 6 figures.

That’s not true. Part of the power of the pardon, historically, has been to stop unjust prosecutions.

The DOJ has a policy regarding pardons. But that is not law nor does it have anything to do with The Constitutional power to pardon.

An appeals court recently affirmed this position, btw.
