Gorsuch doesnt just ask questions for fun. His repeat questions re "otherwise" suggest to me that he, at least, could go either way here.

Mr. Redd died shortly thereafter. The State petitioned for rehearing en banc, asking the court to vacate the opinion as moot. The Ninth Circuit denied rehearing, over a 7-judge dissent. cdn.ca9.uscourts.gov/datastore/op...
The State then petitioned for cert, supported by 18 other states. 2/3
