Whether that’s used in good faith or as a smokescreen is a political question, but the mechanism is real.

Trump's current move is smarter than he is. Someone is giving him help here. Because this will work, as things stand now.

So if DOJ opens or re-opens some “active investigation,” they can say:
“These particular pages fall under ‘jeopardize an active investigation’ so we’re holding those back for now.”
That’s not just “policy”; it’s baked into both FOIA and the current draft text of the Epstein Files Trans. Act.

The Epstein bill itself, H.R. 4405 (Epstein Files Transparency Act), which explicitly allows DOJ to withhold bits that would “jeopardize an active federal investigation or ongoing prosecution,” but says that has to be narrowly tailored and temporary, and they have to justify redactions.
