Yes, they believe that habeas corpus is Latin American and must be stopped. They don't realize that it is Latin AND American!

She thinks habeas corpus is Latin American so should be eliminated at all costs. She doesn't realize it's both Latin AND American.

Not arguing about Hasan Piker's beliefs or value of his speech. Arguing for the rule of law, the Bill of Rights and the freedom of all persons in this country.

Throwing out accusations and claims does not make it real. Limiting our rights has been a tactic every administration has used by pitting one group against another. We the People need to stand up for each other.
May 13, 2025 at 7:45 PM
Curious - Let's say the US government were to adopt Russia's assertion that Ukraine supports terrorists in the eastern regions that attacked Russian citizens. In that scenario supporting Ukraine means supporting terrorists. Meaning your posts would be supporting terrorism. Is that the logic?
May 13, 2025 at 7:43 PM
Ultimately we need to keep all branches and agencies of the US government in check and in their lanes. Our rights are spelled out clearly and there are limits. If a person engages in illegal behavior the correct agency should engage. Otherwise we could end up with arbitrary enforcement.
May 13, 2025 at 7:36 PM
Sure, the CBP can question about anything, but they cannot deny entry to the US to citizens. What then is the point of the questioning? In this case, Hasan Piker's speech is public so if the appropriate authorities deemed it illegal they can prosecute him. That is not CBP's jurisdiction.
May 13, 2025 at 7:34 PM
Non-citizens can be questioned about their beliefs and things they have said and can be denied entry. This is a slippery slope that is already being abused. Immigrants who disagree with the current administration have been denied entry.
May 13, 2025 at 7:31 PM
Correct - all people (citizens, green card holders, visa holders) can and should be questioned upon entry into the US. They should be questioned about where they visited, what they are carrying, etc. Citizens should not be questioned about their beliefs or things they have said.
May 13, 2025 at 7:29 PM
Those are correct arguments. However, it is not for the CBP to decide what speech is considered legal. If Hasan Piker violated the law, then he is entitled to a trial. Due process is important too. The heart of this article is about a US citizen that was detained and asked about his speech.
May 13, 2025 at 7:17 PM
If Hasan Piker violated a law then he can be arrested and tried for that.
If we get to decide what is appropriate speech, then the definition can change at will. Speaking against the government would become illegal. Hasan Piker has said things people find inappropriate that doesn't make it illegal

Claiming someone supports terrorists and detaining them is not allowed. If they materially support a terrorist organization and are arrested, charged and convicted, then yes that speech is not protected. Limiting rights of one person you disagree with can have the consequence of impacting ALL of us.

Problematic speech is still protected by the 1st Amendment. At the border it cannot be used to detain or intimidate US citizens. The KKK, neo-Nazi groups, anti-Israel groups, anti-government militias, BLM protesters, BDS supporters, etc. are ALL covered and protected by the Bill of Rights.

Americans need to push for legislation that sets limits on CBP's authority and overreach.

Let's list some facts:
- This is an American citizen by birth
- The government should not be able to detain and question citizens about their beliefs (ideally not legal residents either)
- CBP's has been extending their authority and testing the boundaries of what is allowed without accountability

He is confused by the term Habeas Corpus. He thinks it's Latin American and has no place here. He doesn't understand that it is Latin AND American.

Perhaps this administration dislikes Habeas Corpus so much because they think it's Latin American instead of Latin and American? 😀

He's not wrong, but he's definitely not right.

The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.
This in Article I - dealing with the powers (or limitations) of Congress. The Executive branch does not have the right to suspend Habeas Corpus.
