7. Is this Bill compatible with EU law? What does recent legal advice state? Until October 2024, successive Irish governments blocked the Occupied Territories Bill, citing concerns that it would breach EU trade rules. This was despite the Bill passing nearly all necessary stages in both houses of the Oireachtas, with both the Dail and the Seanad voting in favour. However, recent legal opinions confirm that Ireland is entitled to ban trade with Israeli settlements under EU law. While trade rules are generally uniform across all EU member states, exceptions can be made for reasons of public morality, public policy, public security, and the protection of human health and life. The two newly published formal legal opinions from Professor Takis Tridimas and Professor Panos Koutrakos, leading experts in EU trade law, affirm the legal basis of the Bill and its compatibility with EU law. They state that Ireland is fully entitled to pass the Occupied Territories Bill and ban trade with illegal Israeli settlements. The legal experts criticised the previous Attorney General's advice, which blocked the Bill, as "erroneous" and "at odds with settled EU case law." Following this landmark judgement, in October 2024, the Irish Government sought updated legal advice from Attorney General Rossa Fanning, which reaffirmed the ICJ's ruling. This is hugely significant, as it has now cleared the way for the Occupied Territories Bill's passage by the Irish government. Several commentators have pointed out that excluding services from the Occupied Territories Bill is not based on legal or constitutional concerns. Attorney General Rossa Fanning's 2024 advice confirmed the Bill's legality. The International Court of Justice opinion is that states have an obligation to end all trade with settlements - that includes both goods and services.

NEWLY PUBLISHED LEGAL OPINION The rish government has opposed the OTB based on advice of the Attorney General that only the EU can ban trade with illegal settlements. In a newly published legal opinion, two leading experts on EU law have stated that Ireland is fully entitled to pass the Occupied Territories Bill, criticising the Attorney General's advice as "erroneous" and "at odds with settled EU case law" The experts state that: "It is striking that the AG should have ignored the judgements in [two cases] where the European Court of Justice expressly held that Member States may deviate from EU law, including... on public policy grounds in order to protect fundamental rights... The analysis and conclusion in the AG Opinion that the Occupied Territories Bill is inconsistent with EU law [is] not only unconvincing but also at odds with settled EC case law”
