It's not surprising that argument that models literally store training data wasn't a sure-fire bet, but the Judge's ruling that models don't "reproduce Copyrighted Works" is just total bunk.
Even with the strictest definition of copyright works, it's trivial to get a model to output trademarked IPs:

Out of all of the children's media moral panics, the TMNT one is the funniest. It wasn't even over the much more violent Mirage comics; it was over the 1987 cartoon! It got to the point where Mikey's nunchaku weren't allowed on screen few seasons in, and the couldn't say Ninja in the Euro markets:

Had that Midnight Craving for egg drop soup..
It honestly turned out lovely! That dark soy sauce and especially the garlic really made the broth feel rich and flavourful. I'd readjust the amount of garlic if making this for someone else, but this recipe made up on the spot was a winner.

On one end of the gaming shelf, one of the most hated sequels in gaming history. It's a shame C&C4 turned out the way it did.
On the other end, however, not one but *3* of the most beloved games from the late 2000s PC gaming era. I'm still playing all 3, especially TF2, to this day!
