Unlike in Dalton, the statute here enumerates three predicate conditions for the President’s decision to call forth the National Guard. As the district court explained, the text of the statute does not make the President the sole judge of whether one or more of the statutory preconditions exist. See 10 U.S.C. § 12406. Thus, we disagree with Defendants’ contention that § 12406 completely precludes judicial review of the President’s determination that a statutory precondition exists.

The Supreme Court TERM Act would: • Establish terms of 18 years in regular active service for Supreme Court justices, after which justices who retain the office will assume senior status; • Establish regular appointments of Supreme Court justices in the first and third years following a presidential election as the sole means of Supreme Court appointments; • Require current justices to assume senior status in order of length of service on the Court as regularly appointed justices receive their commissions; • Preserve life tenure by ensuring that senior justices retired from regular active service continue to hold the office of Supreme Court justice, including official duties and compensation; and • Require a randomly selected Supreme Court justice who has assumed senior status to fill in on the Court if the number of justices in regular active service falls below nine.

Finally, the harms and equities are weighty on both sides. But in my view, they tilt toward the Government because plaintiffs have not represented that they would return the grant money if the Government were to ultimately prevail in the merits litigation

Interestingly, McDonald claims that he chose for termination grants “that did not contribute to the public’s confidence in how NEH expended its taxpayer funds as required by NEH’s authorizing statute. See 20 U.S.C. § 951(5).” N.D. Cal. McDonald Declaration ¶ 21 (emphasis added). But the agency’s authorizing statute specifically requires the NEH to support and subsidize activities that “reach or reflect the diversity and richness of our American cultural heritage, including the culture of, a minority, inner city, rural, or tribal community.” 20 U.S.C. § 956(c)(4).

When the lower courts blocked some of the president’s efforts to freeze federal grant money and fire career government employees, the Supreme Court mostly left those orders in place. When District Judge James Boasberg ordered the Trump administration to “facilitate” the return of Kilmar Abrego Garcia, who had been deported to El Salvador without due process, the justices upheld the order — and he is now back in the US, albeit facing new criminal charges. When other detainees slated for deportation sought their day in court, the justices affirmed their due process rights.

DOGE did not appear to use Musk’s own AI model, Grok, when it set out to build the government-wide email system in the first few weeks of the Trump administration. At the time, Grok was a proprietary model belonging to xAI, and access to its API was limited. But earlier this week, Microsoft announced that it would begin hosting xAI’s Grok 3 models as options in its Azure AI Foundry, making the xAI models more accessible in Microsoft environments like the one used at OPM. This potentially, should they want it, would enable Grok as an option as an AI system going forward. In February, Palantir struck a deal to include Grok as an AI option in the company’s software, which is frequently used in government.

One, I recognize that the trio of judges who decided to sideline me are somewhat conservative, and in that sense, mirror our United States Supreme Court. So I do think the odds of me ultimately prevailing may have been long. And even more, it would have literally taken a long time. It could have been up to a year. And I've seen the damage that is being done to federal agencies on a day-by-day, even hour-by-hour, basis. And I didn't think I could — in any meaningful way — pick up the pieces a year from now, even if I prevailed.
