The burden of proof may be the same on paper, but magistrates sit daily within the same system as police and prosecutors. Conviction rates are higher as a result. A jury is independent, more sceptical, and far more likely to challenge weak evidence and missing witnesses.

A Florida court probably would not have jurisdiction over the BBC UK, unless Trump could prove that the BBC purposefully targeted Florida or had direct business activity there related to his claim. The court would almost certainly dismiss for lack of personal jurisdiction.
