Berkeley law prof guy, erstwhile Georgetown, DOJ, & points in between. Mostly boring tax stuff; occasional dollops of nonprofits, law & econ, etc. Could be arguing in my spare time.
We just introduced the #CABillionaireTax and already the Wall Street Journal is...is...huh. Is apparently running op-eds in support?

Lol, but also just to be a pedant I note that both the tax provisions are unavailable to undocumented workers.

Maybe not just for NEPA. While there is room to zag back again, on its face the opinion seems to just offer an example of how the Court thinks Loper Bright should be applied, not necessarily limited just to NEPA.
E.g., this passage could probably apply to just about any statute:

This passage from today's scotus admin. law decision (/https://www.supremecourt.gov/opinions/24pdf/23-975_m648.pdf) looks to be quite important to what "deference" is, and unfortunately I don't really have any idea what it means (and I don't think lower courts will know what it means, either).

Normally not worth my time to reply to anonymous randos, but here it is sufficiently hilarious that this person failed to read literally 4 more lines that I will.

Happy "tax professors post about their work" day to the nerds who celebrate it. Hey, did you know that a few thousand trusts hold more than 5% of all U.S. wealth? And that we'll never be able to tax any of it? Read more:

I said before that it would be illegal for IRS to turn over tax data on undocumented workers to ICE. Here's why.
In general, it is a federal crime for a federal employee to disclose tax return information. www.law.cornell.edu/uscode/text/...
The possible exception here is 26 USC 6103(i)(2).

Fun fact: Laffer was scooped on the so-called Laffer curve by James Clark, the Speaker of the U.S. House of Representatives, in 1916. I call it the Clark Curve, personally.

Appropos of my notes over the weekend that the administration is hinting it maybe favors a VAT-like new tax called the DBCFT (but is pretending this is a "tariff"), see the attached warning from @kclausing.bsky.social about that path.

This is of course joint work with @dgamage and Darien Shanske.
I guess no one makes long threads on Bsky so I'll just paste the abstract here and take questions...
