Disparate impact means that even if a policy isn’t intended to discriminate, it can still be illegal if it ends up disproportionately harming one group over another.

This move also cancels rules that warned schools not to unfairly discipline students based on race. Bottom line: this order makes it easier for systems to quietly keep treating people unfairly while pretending everything is equal. That’s not justice it’s a cover-up.

That matters because many forms of discrimination today are subtle and hidden in data. By ending this protection, the government is making it much harder to prove discrimination unless someone openly admits to it.
