Originally enacted as a public health law, Title 42 was used during the pandemic to expel migrants at the border under the guise of protecting public health. However, it’s not an immigration policy and was never intended to address long-term migration issues.

This "Remain in Mexico" policy requires asylum seekers to stay in Mexico while their U.S. cases are processed. But here’s the catch: it depends entirely on Mexico’s cooperation. Without Mexico’s agreement to house and support migrants, the U.S. cannot enforce this policy.

The 14th Amendment to the Constitution guarantees citizenship to anyone born on U.S. soil. An executive order cannot override the Constitution. Changing this would require a constitutional amendment, a process designed to be extremely difficult.

Dems didn't appear to carve a narrative to counter the predominant one of mass deportations. The campaign shied away from immigration issues, except maybe for border security. The KFT policy was a chance to undergird a positive message about immigrants and families, but hidden from public discourse
