I had the honor of meeting former Governor Edgar when he spoke my legislation class of just 20 students in 2010 I think. He made a point to find a connection with each of us, showed a wonderful sense of humor. It was a pleasure to spend time with him.

I know this law inside and out. I am a prosecutor and have to reference this statute daily. I am not wrong. What are your qualifications?

If an offense is not detainable under the pre-trial fairness act, judges CANNOT detain them.

Most Aggravated Battery charges fall under this category. Aggravated Battery to a Police Officer Class 2 Felony - not detainable.

The legislators that wrote the PFA actually openly boast that they wrote the law without consulting judges, prosecutors, defense attorneys, police, etc. I am not incorrect. They speak on this frequently. I use this law daily in my job. Trust me, I research.

The system was working quite well when Illinois passed category A and Category B offenses several years ago. People generally were not held on nonviolent offenses.

Now judges have no discretion if the crime is not clearly listed as detainable - and there are some violent crimes that got missed!

No, I am talking about true threats to kill spouses left over voicemails or sent in texts. Assault is something else entirely in Illinois.

Why do threats on public officials get detained? Self serving laws written by people who did not consult anyone with experience in the justice system.
