ASF is not a party to any EHO lawsuit or action. However, we agree the main suit against the county established that the county failed to ensure that Arlington could provide for services and infrastructure for the medium density areas it created with EHO zoning.

Enumerate the items on the dashboard list of approved projects and include on the list the civic association for each project.

Revise the county’s “standard EHO intake forms” to show the legal underpinnings for each EHO permit issuance and better explain the application, rejection, voiding and issuance dates;

Post a notice on the EHO home page that the program is subject to ongoing legal challenges, noting that some projects have been approved and citing the dates of approval by the county of the EHO permit and the legal reasons for the approval;

Confusion seems to be part of the County’s plan. ASF believes County leaders should be forward leaning and issue public statements every time the program is resumed or shut down. ASF requests that the County revise its webpage and dashboard as follows:

The plaintiffs on October 13 also filed a request for an emergency stay of the Appeals Court ruling. Until there is a ruling on this request, ASF assumes the County is leaving the program (and the webpage) “as is.”

Not So Fast??! EHO May Be on the Rocks Again Soon

ARLNow has also reported that the plaintiffs in the original lawsuit, Nordgren et al vs. County Board of Arlington Virginia, on October 6 appealed the Appeals Court ruling to the Supreme Court of Virginia.

A county official told ASF in late September that EHO was back in play due to the Appeals Court ruling and would not confirm if the county is notifying those receiving EHO permits now of possible legal jeopardy. It seems ill-advised not to do so.

The county also approved two “new” permits (the ones from Wilson Ventures who filed the case to the Court of Appeals). Suddenly, Arlington had 47 EHO projects up from nine with no real public notice. The approvals are backdated to 2023 and 2024,

Even more stealthy, one had to dig down into the EHO dashboard to see that the county in September and early October 2025 approved 38 voided permits from among the 45 originally-approved Expanded Housing Option (EHO) permits.

“On September 5, 2025, the Virginia Court of Appeals again reversed the Circuit Court’s judgment in the EHO trial and sent the case back to the Circuit Court. As of October 1, the EHO Permit type in Permit Arlington is available for new applications.

Wilson Ventures claimed they were an “indispensable party” and should have been allowed to join the defense (Arlington County) to contest the initial lawsuit that sought to overturn the program.

On September 5, 2025, the Virginia Court of Appeals reheard a request from Wilson Ventures, LLC, which had been granted two EHO permits that were subsequently voided when an Arlington Circuit Court Judge ruled the program void in September 2024.
