The U.S. Trade Representative released its 2025 Special 301 Report, evaluating intellectual property protection and enforcement among trading partners. This report identifies countries on the Priority Watch List or the Watch List. Mexico was elevated from the Watch List to the Priority Watch List.

Effective May 13, 2025, the USPTO will accelerate the Issue Dates for patents after issue fee payment to approximately 2 weeks. To maintain copendency with the parent application, any continuing applications should be filed before—or at the same time as—paying the issue fee.

The USPTO has terminated the Climate Change Mitigation Pilot Program. This program was a replacement of the Green Technology Pilot Program, which was designed to positively impact the climate by accelerating the examination of patent applications for innovations that mitigate climate change.

Effective April 17, 2023, the USPTO is suspending tis expedited examination of design applications. Any request for expedited examination filed on or after April 17th will not be granted. The USPTO will refund the fee associated with any request filed on or after the effective date.

The USPTO announced that the First-Time Filer Expedited Examination Pilot Program will expire on March 11, 2025. This pilot program offered eligible first-time filers expedited initial written feedback on their application from patent examiners.

On January 1, 2025, Canada has implemented a new Patent Term Adjustment (PTA) practice to address delays in prosecution. Some key factors: a PTA request must be filed within three months of patent issuance; and pay a fee of $2,500 that is refundable if administrative requirements are not met.

Big news! The European Patent Office and Costa Rica signed a validation agreement on 13 December 2024. This will allow European Patents to be validated in Costa Rica with the same effect as national patents

The USPTO is withdrawing the Notice of Proposed Rulemaking published in the Federal Register on May 10, 2024, that would add a new requirement for an acceptable terminal disclaimer filed to obviate (that is, overcome) nonstatutory double patenting.
