The executive branch determines for the executive agencies. I don’t really trust Schumer at the moment, and other sources that have discussed this issue in the past indicate that what he is claiming isn’t how this works. I am no expert in this, so would be open to other sources.
In the federal government’s non-political branch, the Judiciary, the Supreme Court Justices and all appointed Justices also will get paid. Article III, Section 1, says, “The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office.” And like in the Executive Branch, the court determine which essential staff members are needed to support “the judiciary under the Constitution, including activities that support the exercise of Article III judicial powers (i.e., the resolution of cases).” The staffers would need to report to work and would get paid after the shutdown ends

In a 4-3 decision, Pennsylvania's Supreme Court <em>sided with the voters</em> (emphasis added).The court determined that a naked ballot is automatically void, meaning it was never received or counted by the Board of Elections. Under that logic, if the ballot was never received, a voter is eligible to cast a provisional ballot. <em>The Pennsylvania Republican Party and the RNC appealed to the U.S. Supreme Court </em> to block the decision (emphasis added). They argued that the state supreme court's decision "dramatically change[d] the rules governing mail voting" and usurped the state legislature's role of regulating federal elections. On Friday, <em>the Supreme Court declined to intervene, leaving in place the Pennsylvania Supreme Court ruling</em> that allows provisional votes to be cast and counted when a "naked" mail-in ballot is invalidated (emphasis added).
