i haven't had time to read the arguments or the opinion. do they deal with evolution and climate change opt outs? that seems like a serious problem for public education that this rule might extend to.

heightened scrutiny is dead bc of sports; see forthcoming BPJ and Hecox ops. animus is the only argument. the differential treatment of precocious puberty and dysphoria was as good a place to raise it as any. it will also be key to bathrooms post sports. shrug!

well as i’ve long said i thought the strategy should have been animus under rational basis review, but that’s hopeless for sports so they had to aim higher. (too high.)

well puberty blockers weren’t even available in the US until fairly recently, so it’s unavailable—>available—>state by state patchwork; i don’t think the context is too different

i think one big reason all this is happening is pretty much all anyone had in their heads in 2010 was bathrooms and in 2025 a big section of the opinion was about the obvious issues sports inclusion raises.

i know that i'm a lawyer and most people aren't, but why isn't anyone being like, obviously the ruling was about the language of the statute, not metaphysics.

yes, but arguendo because the advocates conceded the issue, indicating both that they could win with it and that it would be challenging to dispute with plain meaning and an old statute. i'll have to read more about the GRA i guess.

pardon my ignorance: the GRA supplemented an earlier statute, & then the ERA amended that statute? couldn't it have modified the operation of the GRA? definition-wise the opinion isn't very different from the assumed definition of sex in bostock...

isn't it pretty plausible that this is what Parliament meant by sex/sexual orientation though? i don't know british statutory interpretation but the opinion doesn't seem very textualist.

well, shorthand, but is it "discrimination" in the first place, or is it permissible differential treatment. i think different bathrooms in the ordinary case are not the forbidden kind of "discrimination" period; it's not that they're harmless.
