In other words, these harms aren't hypothetical. But they often burden people who exist outside normative conceptions of community (unhoused residents, delivery drivers, domestic workers). We need a broader conception of community and who has a stake in the use of public space.

This article leverages all kinds of news stories, ranging from Citizen fomenting a manhunt for an innocent man to Ring cameras prompting men to confront and shoot at an innocent woman sitting in her car.

Instead of looking to privacy law, I argue that public nuisance doctrine helps us explore harms against the community as a whole. In particular, the way that private surveillance can harm substantive freedom and equality in the use of public roads.

I also argue that the buildup of private surveillance fuels a level of paranoia that ends up transforming public roads into an extended battleground for protecting private property.
